Terms & Conditions

These Terms & Conditions govern the use of Studio 345’s services, memberships, class packs, facilities, website, and booking systems. By purchasing a membership, booking a class, attending the studio, or using Studio 345 services, you agree to be bound by these Terms & Conditions.

1. MEMBERSHIPS & CLASS PACKS

1.1 Membership Structure

Studio 345 offers a range of weekly membership options providing access to a specified number of classes per week.

All memberships are billed via automatic recurring weekly direct debit using the nominated payment method supplied by the member.

Membership inclusions, pricing, and benefits may vary depending on the membership type selected.

1.2 No Lock-In Commitment

Studio 345 memberships are offered on a no lock-in basis.

Members may cancel their membership at any time by providing a minimum of two (2) weeks’ written notice to Studio 345.

Cancellation requests:

  • must be submitted in writing or through the approved booking platform;

  • cannot be backdated; and

  • will take effect following completion of the applicable notice period.

Members remain responsible for all payments scheduled during the notice period.

1.3 Weekly Class Allocation

Memberships include a fixed number of class credits allocated weekly based on the selected membership type.

Unused classes on standard memberships:

  • do not accumulate;

  • do not roll over; and

  • expire automatically at the conclusion of each billing cycle.

Unused classes are non-refundable and non-transferable.

1.4 Foundation Member Rollover Privileges

Rollover privileges are exclusively available to Foundation Membership holders.

Eligible Foundation Members may roll over a maximum of one (1) unused class into the immediately following billing period, subject to the following conditions:

a) Rolled-over classes must be used within the immediately following week;
b) Rolled-over classes cannot accumulate beyond one additional class;
c) Any unused rolled-over class expires automatically after the following billing cycle;
d) Rolled-over classes are forfeited upon cancellation, suspension, failed payment, or membership termination;
e) Rollover privileges apply only while the Foundation Membership remains active and in good standing.

Studio 345 reserves the right to revoke rollover privileges where memberships are abused or payment obligations are not met.

1.5 Introductory Offers

Introductory offers, including promotional class packs, are strictly limited to one purchase per person unless otherwise stated.

Introductory offers:

  • are available to new clients only;

  • are non-transferable;

  • are non-refundable; and

  • must be used within the validity period specified at purchase.

Unless otherwise stated, introductory offers are valid for seven (7) consecutive days from the date of first class booking.

Unused classes remaining after expiry will be automatically forfeited.

Studio 345 reserves the right to cancel or refuse introductory offers where misuse, duplicate accounts, or fraudulent activity is suspected.

1.6 Foundation Memberships

Foundation Memberships are limited promotional memberships offered at a special introductory rate.

Foundation Membership pricing remains locked in while:

  • the membership remains active;

  • payments remain up to date; and

  • the member complies with these Terms & Conditions.

Foundation Members may receive exclusive benefits including:

  • rollover privileges;

  • reduced cancellation windows;

  • promotional pricing protections; and

  • additional benefits determined by Studio 345 from time to time.

Foundation benefits may be revoked if:

  • the membership is cancelled;

  • the membership remains frozen beyond the permitted freeze allowance;

  • payment obligations are not met; or

  • the member breaches these Terms & Conditions.

Foundation Memberships cannot be transferred, reassigned, paused indefinitely, or reactivated at a later date with the same benefits unless approved by Studio 345 in writing.

1.7 Membership Activation

Memberships commence from:

  • the date of first class booking; or

  • the first scheduled billing cycle,

whichever occurs first.

Members are responsible for activating and utilising memberships within reasonable timeframes.

1.8 Non-Transferability

Memberships, class packs, promotional offers, and credits are strictly non-transferable.

Memberships may not:

  • be shared;

  • be assigned to another person;

  • be resold; or

  • be used commercially.

Any attempt to transfer or misuse memberships may result in immediate suspension or termination without refund.

2. PAYMENTS & BILLING

2.1 Direct Debit Authority

By purchasing a membership, members authorise Studio 345 to process recurring direct debit payments using the nominated payment method provided.

Members are responsible for ensuring:

  • payment information remains current;

  • sufficient funds are available; and

  • payment methods remain valid.

2.2 Failed Payments

If a payment fails:

a) a $10 failed payment fee may be charged;
b) Studio 345 may attempt to reprocess the payment;
c) the member will be notified of the failed transaction; and
d) access to bookings or classes may be restricted.

Repeated failed payments may result in suspension or termination of membership access.

2.3 Grace Period

Studio 345 may provide a short grace period following a failed payment at its discretion.

During this period:

  • members may temporarily retain booking access; however

  • Studio 345 reserves the right to suspend bookings, attendance privileges, or membership benefits until outstanding amounts are paid.

Grace periods are not guaranteed and may be withdrawn at any time.

2.4 Outstanding Balances

Members remain responsible for all unpaid balances, fees, penalties, and outstanding charges.

Studio 345 reserves the right to:

  • suspend memberships;

  • cancel future bookings;

  • revoke promotional benefits;

  • deny entry to classes; or

  • refer unpaid debts for recovery

until all amounts are paid in full.

2.5 Pricing Changes

Studio 345 reserves the right to amend:

  • membership pricing;

  • class pack pricing;

  • fees;

  • schedules; and

  • service offerings

at any time with reasonable notice.

Price changes may occur due to operational costs, business requirements, or service changes.

2.6 Foundation Pricing Protection

Foundation Members are exempt from general membership price increases while:

  • the membership remains active;

  • payments remain current; and

  • the membership is maintained continuously.

Foundation pricing protections may be forfeited if the membership is cancelled or otherwise terminated.

3. BOOKINGS, ATTENDANCE & WAITLISTS

3.1 Booking Window

Members may book classes up to fourteen (14) days in advance through the Studio 345 booking platform.

Bookings are subject to:

  • class capacity;

  • instructor availability; and

  • operational requirements.

3.2 Class Capacity

All classes have limited capacity and bookings are confirmed on a first-come, first-served basis.

Studio 345 reserves the right to:

  • limit bookings;

  • adjust capacity;

  • modify equipment allocation; or

  • refuse participation

where necessary for operational, safety, or service quality reasons.

3.3 Waitlist

Studio 345 operates a waitlist system for fully booked classes.

By joining the waitlist, members acknowledge and agree that:

  • they may be automatically added into class if a position becomes available;

  • standard cancellation policies continue to apply;

  • they are responsible for monitoring booking notifications and waitlist status.

3.4 Waitlist Cut-Off

Members may be automatically added from the waitlist up to two (2) hours before the scheduled class start time.

After this time, Studio 345 may release remaining spaces at its discretion.

3.5 Attendance & Late Arrival

Members are encouraged to arrive prior to class commencement.

Late arrivals may be permitted at instructor discretion; however:

  • entry is not guaranteed;

  • instructors may require members to wait before joining the class;

  • participation may be refused where late arrival compromises safety, class flow, or instruction quality.

No refunds or credits will be issued for refused late entry.

3.6 Member Responsibility

Members are solely responsible for:

  • managing bookings;

  • cancelling classes;

  • monitoring waitlist status; and

  • maintaining accurate account information.

Studio 345 is not responsible for missed classes resulting from failure to manage bookings appropriately.

4. CANCELLATIONS & NO-SHOWS

4.1 Standard Cancellation Window

Standard members must cancel bookings at least six (6) hours before the scheduled class start time.

4.2 Foundation Member Cancellation Window

Foundation Members may cancel bookings up to four (4) hours before class commencement without penalty.

4.3 Late Cancellations

Cancellations made within the applicable cancellation window will result in:

  • forfeiture of the booked class; and

  • a $3 late cancellation fee.

4.4 No-Show Policy

Failure to attend a booked class without cancellation will result in:

  • forfeiture of the booked class; and

  • a $4 no-show fee.

4.5 Waitlist Bookings

Members added from the waitlist remain subject to all cancellation and no-show policies.

5. MEMBERSHIP FREEZES

5.1 Freeze Requests

Members may request a temporary membership freeze by providing a minimum of two (2) weeks’ written notice.

Freeze requests:

  • cannot be backdated;

  • are subject to approval; and

  • must align with billing cycles where reasonably possible.

5.2 Annual Freeze Allowance

Memberships may be frozen for a maximum of four (4) weeks per calendar year.

Freeze periods may be used:

  • consecutively; or

  • across multiple shorter periods.

Unused freeze allowances do not carry over.

5.3 Freeze Conditions

During an approved freeze:

  • membership payments are paused;

  • class access is suspended;

  • existing bookings must be cancelled in accordance with cancellation policies.

Members remain responsible for any fees incurred before the freeze commencement date.

5.4 Foundation Members

Foundation Members are subject to the same four (4) week annual freeze limit.

Exceeding the permitted freeze allowance may result in forfeiture of Foundation Membership benefits and pricing protections.

6. REFUNDS, TRANSFERS & EXTENSIONS

6.1 No Refunds

All purchases are strictly non-refundable, including:

  • memberships;

  • class packs;

  • introductory offers;

  • retail purchases; and

  • promotional purchases.

Refunds will not be issued for:

  • change of mind;

  • unused classes;

  • scheduling conflicts;

  • relocation;

  • dissatisfaction; or

  • failure to attend classes.

6.2 Non-Transferability

Memberships, class packs, credits, and promotional offers cannot be transferred between individuals.

6.3 Medical Extensions

Studio 345 may, at its discretion, provide extensions or temporary freezes for medical reasons.

Medical requests:

  • may require supporting medical documentation;

  • will be assessed individually; and

  • do not guarantee approval.

Refunds will not be provided in place of extensions.

7. STUDIO ETIQUETTE & SAFETY

7.1 Grip Socks

Grip socks are mandatory for all classes for hygiene and safety purposes.

Members without grip socks may:

  • be refused participation; or

  • purchase grip socks in-studio prior to class.

7.2 Conduct

Members are expected to behave respectfully toward:

  • instructors;

  • staff;

  • other members; and

  • studio property.

Disruptive, abusive, unsafe, or inappropriate behaviour may result in suspension or permanent termination.

7.3 Mobile Phones

Use of mobile phones during class is discouraged.

Studio 345 reserves the right to request phones be silenced or removed from the training area.

7.4 Instructor Authority

Members must follow all instructor directions at all times.

Studio 345 reserves the right to refuse or remove participation where behaviour is:

  • unsafe;

  • disruptive;

  • inappropriate; or

  • non-compliant with studio policies.

7.5 Health Responsibility

Members acknowledge that participation in Pilates and fitness activities involves physical exertion and inherent risks.

Members are responsible for:

  • ensuring they are medically fit to participate;

  • informing instructors of injuries, illnesses, pregnancies, or physical limitations;

  • modifying exercises where necessary.

Participation occurs entirely at the member’s own risk.

8. GENERAL TERMS & LIABILITY

8.1 Changes to Services

Studio 345 reserves the right to:

  • change instructors;

  • amend class schedules;

  • modify services;

  • substitute equipment; or

  • alter operating hours

without liability.

8.2 Studio Closures

Studio closures may occur due to:

  • public holidays;

  • maintenance;

  • staff shortages;

  • emergencies; or

  • unforeseen operational circumstances.

Studio 345 is not liable for temporary interruptions to services.

8.3 Personal Property

Members are responsible for their personal belongings at all times.

Studio 345 accepts no responsibility for:

  • lost items;

  • theft;

  • damage; or

  • misplaced belongings.

8.4 Limitation of Liability

To the maximum extent permitted by law, Studio 345 excludes all liability for:

  • personal injury;

  • property damage;

  • financial loss; or

  • consequential loss

arising from participation in classes or use of studio facilities.

8.5 Acknowledgement of Risk

By attending Studio 345, members:

  • acknowledge the inherent risks associated with physical exercise;

  • voluntarily participate at their own risk; and

  • release Studio 345, its owners, employees, contractors, and instructors from liability except where prohibited by law.

8.6 Agreement to Terms

By purchasing, booking, attending, or participating in any Studio 345 service, members acknowledge that they have read, understood, and agreed to these Terms & Conditions.
